Terms & Conditions of Use & Purchases

Welcome to the online store Gerakina Olive Groves (hereinafter referred to as the “Company”, “we”, “our”) operating on the website https://gerakina-olivegroves.gr/ (hereinafter referred to as the “Website”).

2) Definitions

  • Customer/User: any natural or legal person who visits or uses the Website. 

  • Consumer: a natural person acting for purposes other than commercial/professional activity.

  • Products: the products available for sale (indicatively: olive oil, olives, wine and related items).

  • Order: the electronic request to purchase products through the Website.

  • Sales Contract:
    the contract that is drawn up when we accept your order.

3) General terms of use of the Website 

  1. The Website and its content are provided for information and online shopping, in accordance with these terms.

  2. Malicious use of the Website (e.g. interference, unauthorized access, attempted violation) is prohibited.

  3. We reserve the right to modify, suspend or discontinue functions of the Website when necessary for maintenance, security or upgrade reasons.

4) User account (if provided)

  1. If you create an account, you are responsible for the accuracy of your information and for maintaining the confidentiality of your passwords.

  2. We are not responsible for unauthorized use of your account when this is due to your negligence.

5) Product Information – Availability

  1. We make every effort to ensure that descriptions/prices/photos are accurate. However, there may be errors (typographical, technical or illustrative).

  2. The photos are indicative and there may be minor deviations (e.g. shade/packaging), without this affecting the basic characteristics.

  3. Product availability is updated based on stock availability. In case of unavailability after placing an order, we will contact you for an alternative solution or cancellation/refund.

6) Prices – VAT – Shipping costs

  1. Prices are displayed on the Website as they are current at all times.

  2. VAT (where applicable) and any shipping/cash on delivery costs appear at checkout before completing the order.

  3. If an obvious price error is detected, we reserve the right to cancel the order and inform you immediately, giving you the option of confirming with the correct price or canceling.

7) Order process – Conclusion of a contract

  1. Placing an order constitutes a purchase offer on your part.

  2. The contract is concluded when we confirm acceptance of the order (e.g. with a confirmation email/order status update).

  3. We reserve the right to not accept an order in reasonable circumstances (e.g. suspected fraud, technical error, lack of availability).

8) Payment methods

The available payment methods are displayed at checkout. If payment is made through a payment provider, the details are processed in the provider’s secure environment and we do not store full card details.

9) Shipping – Delivery – Transport Risk

  1. Shipments are made to the address you indicate when ordering.

  2. Estimated delivery time depends on the destination and carrier and is communicated/confirmed to you where possible.

  3. Please check the packaging upon receipt. If there is any visible damage, please report it to the carrier and inform us immediately.

  4. The risk of loss or damage passes to the customer upon delivery of the products.

10) Right of withdrawal (for consumers – online purchases)

If you are a consumer, for distance purchases you have the right to withdraw within 14 calendar days from the date of receipt, without giving any reason.

They are borne by the customer, unless otherwise agreed or if it is our own error/defect.

Refund: After receiving and checking the returned products, we will refund the price using the same payment method (where possible) within a reasonable time.

Exceptions/limitations (indicative):
The right of withdrawal may not apply or may be limited in cases such as:

  • products that are not suitable for return for health/hygiene reasons when the seal has been broken,

  • products that have been opened/used or are not in their original condition,

  • products that deteriorate or expire soon (where applicable).

For food/beverages (e.g. olive oil, olives, wine): for a return to be accepted, the products must generally be unopened/unbroken seal and in excellent condition.

11) Defective/wrong products

In the event that you receive a defective product or one that is different from your order, please contact us as soon as possible so that we can arrange a replacement or refund, in accordance with applicable law.

12) Alcoholic products (wine) – Age restriction

The purchase of alcoholic products (e.g. wine) is only permitted to persons over the age of 18. By completing your purchase, you declare that you meet this requirement.

13) Intellectual property

The content of the Website (texts, images, logos, design) is the intellectual property of the Company or its legal owners and is protected by applicable law. Reproduction/republication without prior written permission is prohibited.

14) Limitation of liability

  1. We make every effort to ensure the proper functioning and security of the Website, without guaranteeing that it will always be uninterrupted or error-free.

  2. We are not liable for indirect/consequential damages, loss of profits or data that may arise from use of the Website, to the extent permitted by law.

  3. Nothing in these terms limits the statutory rights of consumers.

15) Force majeure

We are not responsible for any delay or inability to perform obligations due to force majeure events (indicatively: extreme weather events, strikes, network outages, decisions of authorities, pandemics, transport disruptions).

Note: The European platform ODR (Online Dispute Resolution) has discontinued from 20/07/2025,
therefore it is no longer used as a channel for submitting online complaints.

17) Applicable law – Jurisdiction

These terms are governed by Greek Law. The courts of Greece are competent to resolve disputes, without prejudice to the rights of consumers as provided for by law.

18) Modification of terms

We reserve the right to modify these terms at any time. The then-current version will be posted on the Website with an updated date.
